CITY OF GARRETT, TEXAS
NOTICE OF PUBLIC HEARINGS TO CONSIDER ANNEXATION OF PROPERTY
NOTICE IS HEREBY GIVEN, that a public hearing will be held by the City Council of the City of Garrett, Texas, to consider the annexation of the property hereinafter described. The first public hearing will be held at the Garrett City Hall, 208 North Ferris, Garrett, Texas 75119, on the 28th day of November 2012, at 6:30 o’clock p.m. A second public hearing will also be held at the Garrett City Hall on the 28th day of November 2012, at 6:45 o’clock p.m. Provided, however, if within ten (10) days after publication of this notice more that 10% of the adult residents who reside in the territory proposed to be annexed protest in writing to the City Secretary of the City of Garrett, said second hearing shall be recessed and held on the same date at 6:45 o’clock p.m., at the location of the property proposed to be annexed. Annexation of this land is pursuant to a request from all the owners of said unoccupied property. The property to be considered for annexation is located in Ellis County, Texas and described as follows: TRACT ONE Being that certain tract or parcel of land containing approximately 1.6078 acres conveyed by Grantor Ronald Lee Welch (aka Lee Welch), to Grantee ERE PROPERTY, LLC, and filed of record in Volume 2637 at Page 1225 of the Deed Records of Ellis County, Texas and being described therein as follows: BEING a tract or parcel of land situated in Ellis County, Texas, and being part of the Granville Kirk Survey Abstract 605 and also being part of that 10.888 acre tract of land conveyed to John R. Welch, et ux, by deed recorded in Volume 594 Page 483 of the Deed Records of Ellis County and also being the 1.6076 acre tract of land conveyed to Lee Welch by deed
recorded In Volume 1334 Page 308 of the Official public Records of Ellis County, and being more particularly described as follows: BEGINNING at a point for corner at a 1” Iron pipe found In the westerly line of Interstate Highway 45 at the most northerly corner of said 10.888 acre tract said point also being the easterly corner of the First Tract conveyed to Raymond George Jakubik, et ux, by deed recorded in Volume 489 Page 30 of the Deed Records of Ellis County; THENCE South 35’ 59’ East (record bearing) along the westerly line of Interstate Highway 45 a distance of 250.0 feet to a point for corner at a 1/2” iron rod set; THENCE South 46’ 06’ 27” West along the southeasterly line of said 1.6076 acre tract a distance of 265.6 feet to a point for corner at a 1/2” iron rod set; THENCE North 43’ 63’ 33” West along the southwesterly line of said 1.6078 acre tract a distance of 247.62 feet to a point for corner at a 1/2” iron rod set in the northwesterly line of said 10.888 acre tract; THENCE North 46’ 06’27” East along the northwesterly line of said 10.888 acre tract and the southeasterly line of said Jakublk First Tract a distance of 300.0 feet to the PLACE OF BEGINNING and containing 1.6076 acres. TRACT TWO Being that certain tract or parcel of land containing approximately 9.3279 acres conveyed by Grantor John R. Welch (aka John Robert Welch), to Grantee ERE PROPERTY, LLC, and filed of record in Volume 2637 at Page 1221 of the Deed Records of Ellis County, Texas and being further described therein as follows: BEING a tract or parcel of land situated In Ellis County, Texas, and being part of the Granville Kirk Survey Abstract 605 and also being that 10.888 acre tract of land conveyed to John R. Welch, et ux, by deed recorded in Volume 594 Page 483 of the Deed Records of Ellis County and also being the tract of land conveyed to John Robert Welch by deed recorded in Volume 2554 Page 2009 of the Official public Records of Ellis
County, and being more particularly described as follows: BEGINNING at a point for corner at a 1/2” iron rod set in the westerly line of Interstate Highway 45 said point being South 35’ 59’ East a distance of 250.0 feet from a 1” iron pipe found at the most northerly corner of said 10.688 acre tract and the easterly corner of the First Tract conveyed to Raymond George Jakubik, et ux, by deed recorded in Volume 489 page 30 of the Deed Records of Ellis County; THENCE South 35’ 59’ East (record bearing) along the westerly line of Interstate Highway 45 a distance of 744.34 feet to a point for corner at a 1 1/2” iron pipe found; THENCE South 71’ 18’ 28” West (South 71’ 44’ West, deed) along the southerly line of said 10.888 acre tract and the northerly line of that 6.898 acre tract of land conveyed to Oleta Paden by deed recorded in Volume 668 Page 340 of the Deed Records of Ellis County a distance of 512.57 feet (51 feet, deed) to a point for corner at a 1/2” iron rod set; THENCE North 51’ 11’ 53” West (North 50’ West, deed) along the southwesterly line of said 10.888 acre tract a distance of 441.16 feet to a point for corner at a 1/2” iron rod found in the easterly line of Spur 469 (formerly called Old Highway 75); THENCE North 16’ 36’ 24” West (North 17’ 16’ 40” West, deed) along the easterly line of Spur 469 a distance of 370.26 feet to a point for corner at a 1/2” iron rod set; THENCE North 46’ 06’ 27” East (North 46’ 47’ East, deed) along the northwesterly line of said 10.888 acre tract and the southeasterly line of said Jakubik First Tract a distance of 188.97 feet to a point for corner at a 1/2” iron rod set; THENCE South 43’ 53’ 33” East along the southwesterly line of that 1.6076 acre tract of land conveyed to Lee Welch by deed recorded in Volume 1334 Page 308 of the Official public Records of Ellis County a distance of 247.62 feet to a point for corner at a 1/2” iron rod set; THENCE North 46’ 06’ 27” East along the southeasterly line of said 1.6076 acre
