Friend: Killer drank alcohol before Austin slaying


AUSTIN (AP) — An ex-roommate of a man convicted in the slaying of an Austin police officer has testified the pair drank alcohol the day before the killing.

Prosecution testimony continues Tuesday in Austin in the penalty phase for Brandon Daniel, who could receive the death penalty.

Jurors on Friday convicted Daniel of capital murder in the April 6, 2012, fatal shooting of officer Jaime Padron (HEYE’-may pah-DRONE’). The officer answered a disturbance call at a Wal-Mart.

Kelvin Davis on Monday testified he and Daniel had been drinking at their apartment the day before the shooting. Davis also told jurors that he saw Daniel take six Xanax pills and later finish off a bottle of tequila.

Daniel has acknowledged that he was under the influence of the anti-anxiety drug during the shooting.
