Cayard found not guilty of murder

Phil Bankerphil@ennisdailynews.com

An Ellis County jury found 58-year-old Lynda Cayard not guilty of the 2012 killing of her husband Michael Cayard.

Cayard sobbed softly into the arms of defense attorney Peter Schulte when the jury foreman read the verdict. Mike Cayard’s family, holding hands in the back rows of the courtroom, wept openly as the verdict was read.

Prosecutors Lindy Tober and Jake Heffernan left the courtroom shortly after the reading of the verdict.

Schulte argued on Monday during closing arguments that the state failed to make a convincing case against Cayard, saying the Ellis County Sheriff’s Office conducted a failed investigation.

“I’ve always thought that my client was innocent of the charge,” Schulte said. “But because of the completely inept police investigation done by the sheriff’s department, there was never any way they were going to have enough evidence to convict anyone of this crime.”
