Two arrested on burglary charges

Ennis police detained two Dallas men while in possession of handguns who were implicated in a burglary of a habitation case.
According to the police report, while on routine patrol Officer Eddie Salazar was notified of a vehicle in the area that was spotted leaving a home that was reported to be burglarized. Salazar located the vehicle and made a traffic stop to make contact with the driver. Officer Brad Sherrard arrived at the scene to assist with the stop.
Both officers approached the white Ford Expedition, containing two men inside, and upon speaking with the driver Salazar reported smelling a strong odor of marijuana coming from inside the vehicle. Salazar also said that despite the outside temperature being in the mid-30s, the driver was sweating profusely and appeared nervous. The driver told Salazar he had just finished fighting with a friend and that was the reason he was sweating.
Salazar asked the driver to exit the vehicle after the suspect presented a photocopy of his driver’s license. While the suspect was exiting the vehicle a pistol magazine containing live ammunition fell to the ground and the man picked the magazine up and threw it in the backseat of the vehicle.
Salazar and Sherrard placed both men under arrest in separate patrol vehicles while the suspect’s vehicle was searched. A small black metal box matching the description of a box stolen from the burglarized home was discovered on the floorboard along with a gun hidden in the console. The pistol was missing a magazine, which matched the magazine that had fallen out of the vehicle. The driver admitted to owning the pistol.
A loaded pistol was located on the shoulder of the roadway approximately 100 yards from the vehicle. According to the report, police believe the suspects dropped the pistol out of the vehicle before police could stop them.
Both men were transported to Ennis police department without further incident. Statements from the victim of the home burglary indicated that the two men in custody were involved in the earlier incident.
Derek Boleware, 39, and Sedric Lamon Smith, 35, both of Dallas were charged with burglary of a habitation and felon in possession of a firearm. Boleware and Smith were both previously convicted on a homicide charge.
